Introduction 

Partners of Australian citizens, Australian permanent residents or eligible New Zealand citizens may apply to enter and/or remain permanently in Australia. Partners include:
• people intending to get married
• married (de jure) partners
• de facto partners

Partners from overseas do not have an automatic right of permanent residence in Australia and must apply for the appropriate visa and be formally assessed against and meet all the legal criteria before their visa can be granted.

Visa Subclasses

The different visa subclasses for applying as a partner of an Australian Citizen, permanent resident or eligible New Zealand Citizen are briefly outlined below. You may also wish to use the ‘Visa Wizard’ on the Department of Immigration and Citizenship (DIAC) website which will help you choose the appropriate visa.

Spouse Temporary Visa (Subclass 309) and Permanent Visa (Subclass 100)
For people from overseas to enter and stay in Australia with their partner, who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen

Prospective Marriage Visa (Subclass 300)
For people from overseas to enter Australia, marry their fiance(e), who must be an Australian citizen, Australian permanent resident or eligible New Zealand citizen. Once married, holders of this visa can then apply to remain permanently in Australia.
 

Information Sessions

Partner Visa information sessions will be held regularly at the Australian Visa Offices in Guangzhou and Shanghai. These information sessions help you to prepare your application and give you the opportunity to directly ask DIAC officers any questions you may have about putting together and lodging an application.
