2. Checklist – Subclass 457 Visa

Introduction
Please read through this checklist carefully, as it details the types of documents you will be required to provide in support of your Subclass 457 visa application. It is important that you are able to complete as many of these requirements as possible prior to lodging your application, as this will ensure your application is processed without unnecessary delay. Please note that this checklist refers to a number of documents that are specific to China, as it assumes that the applicant is a Chinese citizen.
When organising required documents please have regard to the following:
• We only accept notarised / certified copies of official documents. In Australia, copies must be certified by a Justice of the Peace or Registered Migration Agent or a person before whom a Statutory Declaration can be made under the Statutory Declarations Act 1959 as a true copy of the original. In China, copies must be notarised by a Public Notary Office.
• Documents in languages other than English must be accompanied by an English translation. In Australia, translations must be performed by a NAATI (National Accreditation Authority of Translators and Interpreters) accredited translator. In China, translations must be performed and notarised by a Public Notary Office.

What is a Public Notary Office?
There are over 3,000 Public Notary Offices (¹«Ö¤´¦ gongzhengchu) in counties, autonomous areas, and municipalities across China. For the contact number of your local Public Notary Office, call directory assistance in China on 114. Public Notary Offices are accredited by the Chinese government to perform a number of notarial roles, including:
• Notarising the authenticity of signatures, translations, copies of certificates, and photocopies with originals; and
• Notarising facts that amount to civil legal acts such as birth, death, marriage, divorce, kinship, identity and qualifications, and the issuing of the relevant Notarial Certificate.
Sponsorship Document Requirements
• Form 1196 Sponsoring Temporary Overseas Employees To Australia (Part A) completed in English;
• Sponsorship application charge;
• A Notarised copy of the company’s Business License;
• A statement providing background information on the company;
• A statement regarding the company’s proposed business in Australia;
• Documentation indicating that the company is aware of, and will make arrangements to ensure it complies with:
1. Workplace Relations legislation (for more information about this, please refer to the Australian Government's workplace relations website www.workplace.gov.au);
2. Occupational Health and Safety legislation (for more information about Australian OH&S legislation, please refer to the website of the Australian Safety and Compensation Council www.ascc.gov.au); and
3. Workers Compensation legislation (for more information, please visit the website of the relevant Australian state or territory government authority);
• An explanation of the steps the company has taken to ensure that adequate arrangements have been made/ will be made for the company to pay Australian income tax (refer to the Australian Taxation Office (ATO) website www.ato.gov.au for more information) and comply with Australia’s superannuation obligations;
• Details of the address(es) that the company intends to operate from in Australia;
• A statement regarding the company’s previous travel / business investigation in Australia including file application numbers and the names and birth dates of employees who travelled;
• Documentation regarding the company’s Financial Status. Examples of this are listed below:
1. A statement that clearly summarises your business’ ability to meet its financial responsibilities for the number of persons sought;
2. Recently audited Financial Reports (balance sheets / profit and loss statements);
3. Notarised tax payment certificates;
4. Sales contracts or agreements between your company and Australian / Overseas companies;
5. Relevant extracts from your business plan including cash flow projections; and/or
6. Evidence of bills of loading.
Nomination Document Requirements
• Form 1196 Sponsoring Temporary Overseas Employees To Australia (Part B) completed in English;
• Nomination application charge;
• Certified copies of the work contract for each individual that has been nominated, including amounts , conditions of employment, and method of payment of salary;
• Please provide the relevant Australian Standard Classification of Occupations (ASCO) code(s) for the nominated position(s). These are available at http://www.immi.gov.au/skills/skill-code.htm; and
• Correspondence of any enquiries made to the relevant authorities in relation to any Australian licensing, registration or membership that employees may require in order to work in their designated trade.
Minimum Salary Levels
Minimum salary levels must be met and do change regularly. As at July 2008 the minimum gross annual salary, based on a 38 hour week, was $59,480 for IT Professionals and was $43,440 for all other gazetted occupations. The gross salary is the salary paid, excluding any additional payments or allowances such as superannuation, accommodation, bonuses, commissions, shares, meals and transportation allowances. The Australian Government is responsible for monitoring salary payments to ensure that they are at the specified level.
Visa Application Document Requirements
• Form 1066 Application for a Temporary Business (Long Stay) visa (subclass 457) completed in English;
• Form 54 Family Composition - English/Chinese;
• A valid passport for each applicant (including spouse/dependants);
• Four recent passport sized photographs of each applicant (including spouse/dependants);
• Form 80 Personal Particulars For Character Assessment (for visa applicants - including spouse/dependants - aged 16 years or over);
• Evidence of English language skills equivalent to an average band score of 4.5 in an International English Language Testing System (IELTS) test, unless you have been exempted under the regulations. For further information on the English language requirement and exemptions please refer to:

• Resumé (Curriculum Vitae); and
• Notarial certificate of your highest education / degree qualification.
Requirements for Spouses/Dependants
If you are applying as a spouse or child as a dependant:
• A statement from your spouse’s sponsoring company on the company’s letterhead indicating that the company supports your application and that their sponsorship undertakings extend to you;
• Notarial certificate of marriage (if you are applying as a spouse); and
• Notarial certificate of birth (if you are applying as a child);
• written and signed authorisation from both parents for a child applicant to be granted a visa (if the child is under 18 years old and one of the parents is remaining in China). The authorisation should include a photocopy of the remaining parent's identity card; and
• Form 47A Details Of Child Or Other Dependent Family Member Aged 18 Years Or Over (for children over 18).
If your spouse has already been granted a subclass 457 visa and you are applying as a dependent:
• Form 1066 Application for a Temporary Business (Long Stay) visa (subclass 457) completed in English;
• Form 54 Family Composition - English/Chinese;
• Notarial Certificate of Marriage;
• Notarial Certificate of Birth;
• A copy of the Sponsorship Approval letter provided to the sponsoring company by the relevant DIAC office; and
• A statement on company letterhead from your spouse’s employer in Australia stating their agreement to extend sponsorship obligations to include you (and your children where applicable).
• Form 47A Details Of Child Or Other Dependent Family Member Aged 18 Years Or Over (for children over 18).
Health Requirements
If you propose to stay in Australia for over 3 months you - and anyone included in your visa application (including your spouse and any dependants 11 years of age or over) - will be required to undertake an x-ray and/or medical examination at an immigration panel hospital during the processing of your application. Dependants under the age of 11 years old will be required to undertake a medical examination instead of an x-ray examination. We will notify you of this after you lodge your application, after which you should make your own arrangements to attend an approved immigration panel hospital. Please be advised that you will need to present a copy of the details page of your passport, your National Identity Card and health ID number to the panel doctor.
