Introduction
Please read through this checklist carefully, as it details the types of documents you will be required to provide in support of your Child Migration application. It is important that you are able to complete as many of these requirements as possible prior to lodging your application, as this will ensure your application is processed without unnecessary delay. Please note that this checklist refers to a number of documents that are specific to China, as it assumes that the applicant is a Chinese citizen.
When organising required documents please have regard to the following:
• We only accept notarised / certified copies of official documents. In Australia, copies must be certified by a Justice of the Peace or Registered Migration Agent or a person before whom a Statutory Declaration can be made under the Statutory Declarations Act 1959 as a true copy of the original. In China, copies must be notarised by a Public Notary Office.
• Documents in languages other than English must be accompanied by an English translation. In Australia, translations must be performed by a NAATI (National Accreditation Authority of Translators and Interpreters) accredited translator. In China, translations must be performed and notarised by a Public Notary Office.

General Requirements
When lodging Child Migration Visa Applications for the Child Category, Orphan Relative Category and Adoption Category applicants are required to submit:
• Form 47CH Application For Migration To Australia By A Child;
• Form 40CH Sponsorship For A Child To Migrate To Australia;
• The visa application charge for child migration. Payment options are listed below:
1. Pay by China Post money order;
2. Pay at a DIAC office in Australia and submit the original pink receipt to us; or
3. Pay in person at our office (Chinese RMB only accepted)
• Four passport photos of the visa applicant;
• Notary Certificate of birth of the visa applicant;
• Certified copy of the child’s original birth certificate;
• Certified copy of the child’s household registration booklet (hukou ben); and
• Evidence that the Australian parent/sponsor is an Australian citizen, Australian permanent resident or eligible New Zealand citizen (eg. Australian Citizenship Certificate, Australian passport or passport with permanent residence visa).
• All applicants aged 11 years old and over are required to undergo a medical and chest x-ray examination. Applicants aged less than 11 years old are required to undergo a medical examination only. You should make your own arrangements to attend an approved immigration panel hospital to undergo these examinations before lodging your Child Migration application (except for "Intercountry" adoptions, as separate health examination arrangements apply for this category). You should ensure that you are aware of the visa subclass that you intend applying for because the panel doctor will need to know this, and you should ensure that you bring the following documents to your appointment at the panel hospital:
1. Form 26 Medical examination for an Australian visa
2. Form 160 Radiological report on chest x-ray of an applicant for an Australian visa
3. Applicant's current passport
4. Two passport-sized photographs per applicant
Child Category
In addition to the general document requirements, the following documents should be submitted:
• Notarial Certificate of No Criminal Conviction for applicants aged 16 years or over. Please refer to www.immi.gov.au/allforms/character-requirements/index.htm for information on character and penal clearance requirements.
• If the Applicant is 18 years or over, evidence that the applicant is wholly or substantially dependent on the sponsoring parent.
• If the child’s parents are divorced, please provide the contact address for the parent who is NOT sponsoring the child to Australia. If the address is in China, please provide the name and address in both Chinese characters and English. The divorce certificate should stipulate what custody and access arrangements the court has ordered.
• If the child’s parents are divorced, please provide the notary certificate of divorce issued by a Law Court or the Civil Affairs Bureau. This certificate must be accompanied by an official English translation certified by the Notary Public Office.
Orphan Relative Category
In addition to the required document the following documents should be submitted:
• Evidence that the child is an orphan, or the child’s parents are of unknown whereabouts or permanently incapacitated; and
• Evidence that the sponsor is a brother, sister, grandparent, aunt or uncle, or niece or nephew of the child.
Adoption Categories
For adoptions involving an Australian state or territory adoption Authority (Intercountry adoptions), the following additional documents should be submitted:
• Notarial Certificate of birth or Notary Certificate of Abandonment;
• Original Certificate of Adoption; and
• Notarial Certificate of Adoption.
For adoptions not involving an Australian state or territory adoption authority ("non-intercountry" adoptions, including expatriate adoptions), the following additional documents should be submitted:
• Evidence that the parents have been residing overseas for longer than 12 months and that they did not deliberately live overseas in order to get around the requirements for adopting an overseas child; and
• Evidence that the laws relating to the adoption in the country in which the child is normally resident have been complied with and that the relevant overseas authority has approved the child’s departure for Australia.
